title: When an employee reports a problem, how the Japan entity should respond
description: Three nurses reported abuse, then faced standby, dismissal and transfer. A 2026 court voided it all without finding retaliation. Reporter treatment is culture.

An engineer says it in the weekly meeting. The feature we are selling to that customer doesn't actually encrypt the data. The room goes quiet for a few seconds. What happens next decides whether anyone in this Japan entity says anything like that in a weekly meeting for the next five years.

You can design what happens next. First, though, a case that did it backwards and took seven years to reach a judgment.

## Three nurses in Sakai

A support centre for people with severe disabilities in Sakai, Osaka. In 2019 a nurse reported to the city that another nurse was abusing residents. The city investigated and found that some of the acts constituted abuse. In 2022 the nurses reported a different matter to the city. This time the city found no violation. After that, three nurses were ordered to stay home for six months, then dismissed, with transfers in some cases. They sued the operating foundation.

On 30 July 2026 the Sakai branch of the Osaka District Court ruled that the dismissals and the standby orders had no reasonable grounds, were inferred to be aimed at pushing the nurses out of the workplace, and were void as an abuse of rights. The foundation was ordered to pay unpaid wages and damages of over 20 million yen. From first report to judgment: seven years.

One detail matters more to me than the outcome. The court did not find that the dismissal was retaliation for the reports. It said a retaliatory purpose could not be inferred. The foundation lost because the dismissal itself had no reasonable grounds. So nobody has to prove you retaliated. If what you did to the reporter after the report can't stand on its own, you lose.

## The legal frame

Japan's Whistleblower Protection Act took effect in 2006. The 2022 amendment requires employers with more than 300 employees to build an internal reporting system. Designated staff who leak a reporter's identity face criminal penalties, and adverse treatment of reporters is prohibited: dismissal, demotion, pay cuts, transfers. A 2025 amendment, taking effect on 1 December 2026, adds criminal penalties for dismissing or disciplining someone because they reported. It presumes that a dismissal or sanction within a year of a report is retaliation, and it bans hunting for the reporter's identity. Entities under 300 people have no duty to build a system, but the ban on adverse treatment applies to every employer.

The law can only govern what you must not do. Those few seconds of silence in the meeting room are outside it.

## How to receive it

The first reaction decides everything. After the engineer finishes, the first sentence out of the manager's mouth is what everyone remembers. "Thanks, we need to check this; let's go through it together this afternoon" is one. "Why are you only saying this now" is another. "Let's not raise this in this meeting" is the third. The third is the most common and the most damaging, because it teaches everyone that problems are raised privately, and privately raised problems have no owner. [Does bad news travel fast](https://nobusato.jp/en/blog/psychological-safety-bad-news?hsLang=en) covered the mechanism. This is the mechanism's first second.

Investigate the problem, not the person. When a report arrives, the organisation's instinct is to ask why he is saying this now, or whether he has history with the person reported. Those questions may have answers, but they have nothing to do with whether the report is true. In Sakai, the city's second finding of no violation did not change the fact that the first finding stood, nor the fact that the nurses had every right to report.

Turn the reporter's situation into a procedure. Thirty, ninety days and a year after the report, has the person's role, evaluation or shift pattern changed? If so, who approved it, for what reason, and can it be explained to a third party? The six months of home standby in Sakai was a change that could not answer that question. A small entity without HR can hand this check to an outside labour attorney once a quarter.

A small entity's channel can sit outside it. A three-person Japan entity cannot run an independent hotline, and the country manager is himself a possible subject. The practical answer is to designate an outside lawyer or labour attorney as the recipient, reachable directly by staff, and to give HQ's hotline a Japanese-language entry. Going over the Japan head's head to HQ is a high psychological barrier for Japanese employees. A channel in Japanese that bypasses the local manager is the minimum condition for problems to surface at all.

And tell the reporter what happened. What was checked, what was found, what was done. You don't owe them every detail. Give them enough to know it was taken seriously. The nurses waited seven years to hear "you were right", and it was a court that said it.

## The real culture

I rarely use the word culture. It's too large. I use a smaller question. The last time someone here said a fact that made everyone uncomfortable, what happened to them afterwards? The answer is the entity's real culture. Among the behavioural baselines that [the first five people](https://nobusato.jp/en/blog/first-five-people-shape-the-next-fifty?hsLang=en) set, this one comes first, because it decides whether any other problem ever gets said aloud.

This article summarises public reporting and the legal framework. It is not legal advice; for a specific case consult a Japanese lawyer or licensed labour and social security attorney. The judgment is described from multiple press reports; the court's written decision was not reviewed.
